TRAVEL
All participants are responsible for making their own way to the tour pick-up points and from the tour drop-off points.
PHYSICAL FITNESS
This workshop may be taken by anyone in good physical condition. Once a trip has started and it is necessary for you to leave the trip because it is beyond your physical level, please note that there will be no refunds for any unused portion of the trip.
MEDICAL
You must be in generally good health and it is vital that persons with medical problems make them known to us well before the workshop begins. It is understood that Ben Messina and Tony Middleton photography is not a medical facility and therefore has no expertise or responsibility regarding what medications or inoculations you and your private physician should decide necessary for your safe participation on the workshop. Ben Messina and Tony Middleton photography assumes no liability regarding provision of medical care. Trip members are urged to check their coverage to be sure it is adequate.
TRIP INSURANCE
We recommend that you have personal health insurance and purchase emergency medical evacuation insurance and emergency medical expense coverage, and trip cancellation insurance, which would reimburse you for non-refundable airfare and trip cancellation fees should you have to cancel the trip due to personal or family illness. Life insurance, baggage loss and baggage delay reimbursement plus other coverage is available.
TOUR FEES
The workshop cost includes the accommodation, tuition fee, transportation and meals. All other expenses are the responsibility of the participants. Not included are any airfares, airport taxes, transportation to and from the pick-up and drop-off points, or items of a personal nature. Price also excludes any insurance coverage for trip cancellation/interruption, travel accident, travel delay, baggage delay or baggage theft (we recommend you obtain coverage for these items), medical or hospitalization expenses.
REFUND POLICY
To secure your booking, we require payment in full. If for any reason you need to cancel your participation in a photo workshop, please notify us at least 30 days before the start of your photo workshop. At that time, you will be charged an $80 cancellation fee and the remaining amount will be refunded. If notification of your cancellation is made less than 30 days before the start of a photo workshop, we will retain the full amount already paid. No cash refunds will be given and no refund of any fees will be made for withdrawal after the photo workshop begins.
Ben Messina and Tony Middleton Photography reserves the right to cancel any photo workshop with inadequate enrolment 14 days beforehand. In the event that a photo tour has to be cancelled due to inadequate enrolment, all fees and deposits paid are refunded in full or transferred to an alternative photo workshop within 12 months of the original tour. No fees will be charged in this situation.
TRANSFER POLICY
If you wish to transfer to a future workshop; please contact us prior to 30 days before the workshop commences. We do not accept transfers within thirty days of the workshop commencing.
CANCELLED TRIPS
We reserve the right to cancel any workshop for any substantial reason, including too few participants or logistical problems such any circumstances, which may make operation of the workshop inadvisable. In case of a tour cancellation, all workshop payments, which were received, will be promptly refunded. This refund will be the limit of Ben Messina and Tony Middleton photography liability. Ben Messina and Tony Middleton photography is not responsible for any expenses or damages incurred by workshop members as a consequence of any cancellation, such as costs expended in preparing for the trip (including non-refundable or penalty-carrying airline tickets), special clothing, lost income, or any other trip-related losses or expenses.
LIMITATION OF LIABILITY OF BEN MESASINA AND TONY MIDDLETON PHOTOGRAPHY
This section defines our responsibility with respect to all of our workshops, please read it carefully:
Payment of your booking fee represents your acceptance of all terms and conditions outlined anywhere on the Ben Messina and Tony Middleton photography websites.
Ben Messina and Tony Middleton photography shall have no liability for any damages, losses, or expenses of whatever cause or nature, including those resulting directly or indirectly from acts of weather, quarantines, strikes, civil disturbance, theft or criminal activity of any kind, government regulations, etc., over which it has no control.
Without limiting the above paragraph, Ben Messina and Tony Middleton photography shall have no responsibility for additional expenses due to unforeseen delays caused by weather, theft or criminal activity of any kind, political disputes, acts of terrorism, strikes, sickness, failure of flights or other transportation to arrive or depart on time, and other causes beyond our control. Ben Messina and Tony Middleton photography cannot assume any responsibility for loss or damage to baggage or personal property.
IN NO EVENT SHALL Ben Messina and Tony Middleton photography HAVE ANY LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWEVER CHARACTERIZED.
Ben Messina and Tony Middleton photography reserves the alter the itinerary when deemed necessary or advisable. The right is also reserved to cancel any workshop prior to departure upon the refund of all payments received, which shall release Ben Messina and Tony Middleton photography from further liability. Ben Messina and Tony Middleton photography is not responsible for additional expenses incurred by trip members in preparing for the trip (i.e. non-refundable advance-purchase air tickets, equipment, etc.)
Ben Messina and Tony Middleton photography reserves the right to decline to accept or retain any member of any trip should such person's actions impede the operation of the trip or the rights or welfare or enjoyment of other members of the trip, and it is agreed that no refunds will be given in such circumstances.
Ben Messinan and Tony Middleton photography reserves the right to take photographic or film records of any of our trips, and may use any such records for promotional and/or commercial purposes.
